Sago Mine Lawsuits
The Sago Mine tragedy that killed a dozen miners in West Virginia
has spawned its 13th lawsuit. Only two families have yet to file
lawsuits against the International Coal Group (ICG) and other
companies deemed responsible for the explosion in January 2006
that killed the miners.
The latest lawsuit in the Sago Mine disaster
has been filed by the widow (Samantha) and ex-wife of miner
David Lewis. The lawsuit was filed against ICG and a number
of other companies that were said to be responsible for
the safety of the mine. The lawsuit states that the Sago
Mine had multiple state and federal safety violations recorded,
plus a high accident rate.
Other similar lawsuits in the Sago Mine disaster, filed
in the Kanawha County Circuit allege negligence
on the part of ICG and other parties and the intentional
infliction
of emotional distress. The lawsuits declare that ICG
and others failed to maintain a safe working environment
and attempted to obstruct an investigation into the disaster
by the families and their representatives.

The Sago Mine lawsuits claim infliction of emotional distress
on the part of ICG by waiting two hours to correct initial reports
that all miners had survived. In fact, only one miner, Randy McCloy
had survived the disaster after writing a goodbye note to his
family. The lawsuits charges that the emotional distress caused
by ICG towards the families was "extreme and outrageous".
